Residential Limited Workmanship Warranty

360° Painting of Dayton warrants that painting procedures performed under the applicable Work Order will be free from workmanship defects for a period of two (2) years from the date of project completion. Any carpentry work performed on removed and reinstalled products is warranted for a period of six (6) months from the date of project completion.

For purposes of this Limited Warranty, a workmanship defect means peeling, blistering, or chipping of a properly applied coating resulting directly from Contractor's failure to perform surface preparation or coating application in accordance with accepted industry standards.

This Limited Warranty applies only to workmanship performed by Contractor. Manufacturer warranties, if any, are provided separately by the product manufacturer and are subject to the manufacturer's terms, conditions, and limitations.

This Limited Warranty covers only defects resulting directly from Contractor workmanship. It does not guarantee the future condition, performance, or longevity of the underlying substrate, previously existing coatings, or conditions beyond the Contractor's control, including but not limited to settling cracks, structural movement, moisture intrusion, acts of God, or other excluded conditions. This Limited Warranty applies only to vertical surfaces and non-metal painted areas unless otherwise specifically stated in writing.

Warranty service shall be rendered during normal business hours, Monday through Friday, between 7:30 a.m. and 3:30 p.m., unless otherwise agreed in writing.

Warranty Claim Procedure
In the event of a claimed workmanship defect, the property owner must contact the local 360° Painting office by phone or in writing immediately upon discovery of the issue. Prompt notification is required to prevent further damage. A detailed description of the alleged defect should be provided.

Upon receiving notice of a claim, 360° Painting reserves the right to inspect the alleged defective condition prior to any corrective work being performed by others. The property owner agrees not to undertake or authorize repairs by third parties without first providing 360° Painting a reasonable opportunity to inspect and remedy the condition.

Failure to provide Contractor a reasonable opportunity to inspect and perform warranty repairs prior to engaging others may void this Limited Warranty.

360° Painting shall be provided a reasonable period of time, not to exceed thirty (30) days from the date of inspection, to schedule and perform any approved warranty repairs, subject to weather conditions, seasonal application requirements, and material availability.

Warranty repairs shall be limited to the specific area exhibiting a covered workmanship defect and shall not require complete repainting of an elevation, wall, room, structure, or project area. Warranty repairs will be performed only to the level of surface preparation originally included within the scope of work.

This Limited Workmanship Warranty Does Not Cover

• Work not performed by the Contractor.
• Work for which the Contractor did not supply the paint or materials.
• Varnished, clear-coated, stained, or natural wood surfaces unless specifically identified in the Work Order as warrantable.
• Surfaces made of or containing galvanized metal.
• Horizontal surfaces or surfaces that permit moisture to collect, including but not limited to decks, railings, stairs, porches, roofs, wood gutters, walking surfaces, and similar applications.
• Exact matching of existing colors, finishes, textures, caulking, stains, or previously weathered surfaces due to aging, fading, environmental exposure, or normal wear.
• Variations in texture, sheen, touch-up appearance, repaired surfaces, lighting conditions, and viewing angles that are consistent with accepted industry standards.
• Repairs necessitated by a defect in the paint, coating, stain, caulk, primer, or other product itself.
• Bleeding caused by knots, rust, cedar, tannins, extractives, or similar substrate conditions.
• Cracks in drywall, plaster, wood, masonry, concrete, stucco, EIFS, or other building materials.
• Peeling, blistering, chipping, cracking, fading, or coating failure caused by mill-glazing, ordinary wear and tear, misuse, abuse, neglect, pre-existing paint failure, structural defects, settling, moisture intrusion, substrate failure, or inadequate maintenance.
• Abrasion, impact damage, mechanical damage, chemical exposure, environmental contaminants, pollutants, or airborne contaminants.
• Failure resulting from previously applied coatings, stains, sealers, paints, or other materials that were improperly applied, incompatible, deteriorated, or otherwise unsuitable for recoating.
• Failure, peeling, blistering, chipping, fading, or other performance issues associated with customer-supplied paints, coatings, stains, caulks, primers, or materials.
• Damage resulting from fire, explosion, flood, extreme weather, wind, hail, vandalism, negligence, alterations, pressure washing, power washing, or other causes beyond the Contractor's control.

Conditions of Warranty Validity
For this Limited Warranty to remain valid, the property owner must:
• Pay the full contract price.
• Retain a copy of the original contract.
• Retain proof of payment in full.
• Provide reasonable access to the property to perform inspections and repairs.
• Properly maintain the painted surfaces, including routine cleaning and prevention of prolonged moisture exposure.
• Promptly address leaks, structural deficiencies, drainage issues, substrate deterioration, or other conditions that may affect painted surfaces.
• Provide timely written notice of any alleged defect.

Additional Terms
This Limited Warranty automatically terminates upon sale, transfer, lease, or conveyance of the property and is valid only for the original purchaser.

All warranty obligations described herein are the responsibility of the independently owned and operated 360° Painting franchise location that performed the work.

This Limited Warranty is the sole and exclusive express warranty provided by Contractor and is in lieu of all other warranties, express or implied, to the fullest extent permitted by law.

In no event shall Contractor be liable for incidental, consequential, indirect, special, punitive, or exemplary damages, or damages exceeding the original contract price.

This Limited Warranty may not be altered, modified, or extended except by a written document signed by both Contractor and Property Owner.
